FREQUENTLY ASKED

QUESTIONS

Below are three categories (Debtors, Creditors, and Attorneys) which provide a list of the most common questions posed by the debtors, creditors, and attorneys to the Trustee.  The answers listed represent the most common response from the Trustee.

Always remember to contact your attorney for legal advice. You pay your attorney for legal representation, therefore your attorney should be the person with whom you obtain legal advise regarding your case.  Should you call the Trustee's office with a legal question and you are represented by an attorney, it would be improper for the Trustee to counsel you.  The Trustee is an administrative arm of this system and while the Trustee may be asked to give an opinion, their main responsibility is to receive and disburse funds in accordance with the Plan, keep records, file reports, and bring matters to the attention of parities of interest when there is a problem with the performance of the Plan.
